Warranty

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Warwick Fabrics (Australia) Pty Ltd (ABN 56 004 832 455) ("Warwick") provides the following warranty in relation to its fabrics ("Product").

The benefits of this warranty are in addition to any rights and remedies imposed by Australian State and Federal legislation that cannot be excluded. Nothing in this warranty is to be interpreted as excluding, restricting or modifying any State or Federal legislation applicable to the supply of goods and services which cannot be excluded, restricted or modified.

WARRANTY

Warwick warrants that, subject to the exclusions and limitations below, the Product will be free from defects in materials and workmanship for a period of 3 years from the date of purchase if the product is used for domestic and / or commercial use.
This warranty is not transferable to a subsequent customer if the Product is sold by the original customer during the warranty period.
If a defect covered by this warranty appears, Warwick will, in its sole discretion replace the Product or the defective part of the Product free of charge or provide appropriate compensation in the form of credit which in the opinion of Warwick is fair in the circumstances.
Warwick reserves the right to replace the defective Product with fabric of similar quality, grade and composition where an identical fabric is not available.

WARRANTY CLAIMS

1. If a fault covered by warranty occurs, the customer must first complete a service form and return it to Warwick at the contact address listed below. The service form is available upon request.
2. Any warranty claim must be accompanied by:
(a) a photocopy of the proof of purchase which clearly states that a Warwick fabric has been purchased; and
(b) photos of the alleged defect including close ups of affected areas and full room shots showing the complete setting of the Product.
3. The customer must, on request:
(a) Provide additional photos;
(b) Provide cushion cover examples; or
(c) Make the Product available to Warwick for an onsite inspection.
4. Warwick will assess the claim and will advise the customer in writing of its decision within 4 weeks of receiving the service form.                                          5. The customer must bear the cost of making the claim including any postage, and must bear the cost of the transport of the replacement fabric from Warwick, and all insurance of the replacement fabric.

EXCLUSIONS

The warranty will not apply where:
(a) The alleged defect in the Product is within acceptable industry variances such as movement of up to 4% in some fabrics;
(b) Warwick cannot establish any fault in the Product after testing and inspection;
(c) The Product has been used other than for the purpose for which it was designed;
(d) The customer has failed to properly clean, use and maintain the Product in accordance with Warwick's performance ratings and care instructions;
(e) the Product has been subject to abnormal conditions, including environment, temperature, water, fire, humidity, pressure, stress or similar;
(f) The defect has arisen due to abuse, misuse, neglect or accident; or
(g) The defect has arisen due to chemical damage.
The warranty does not extend to:
(a) Damage or defects caused by normal wear and tear;
(b) Damage or defects caused by after treatments; or
(c) Minor variations in colour.

LIMITATIONS

Warwick makes no express warranties or representations other than set out in this warranty.
The replacement of the Product or part of the Product is the absolute limit of Warwick's liability under this express warranty.
